By downloading, installing, or using the Boom.ink mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and Boom.ink regarding your use of our AI-powered content creation services. By using our App, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy.

2. Description of Service

Boom.ink is an AI-powered content creation tool designed to help users generate social media content for X (formerly Twitter). Our service uses pre-trained AI models to generate content based on your prompts.

Core Features:

• AI-powered content generation using pre-trained models
• Multiple tone options (Professional, Engaging, Authority)
• Real-time trend integration and hashtag suggestions
• Style matching based on public X profile information

Important Note:

Our AI models are pre-trained and do not learn from or store your personal data. Each content generation is independent and does not affect future generations.

3. User Accounts and Registration

To use certain features of the App, you may need to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

Account Requirements:

• You must be at least 13 years old to create an account
• You must provide accurate and complete registration information
• You are responsible for maintaining account security
• You must notify us immediately of any unauthorized access
• One person or entity may not maintain multiple accounts

4. Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You may not:

• Use the App to create harmful, offensive, or illegal content
• Generate content that violates X (Twitter) Terms of Service
• Create misleading or deceptive content
• Impersonate others or create fake accounts
• Use the App for automated mass content generation or spam
• Attempt to reverse engineer, decompile, or hack the App
• Share your account credentials with others

• Violate any applicable laws or regulations
• Circumvent any content filtering or security measures
• Use the App for any commercial purposes without authorization

5. Content and Intellectual Property

Your Content:

You retain full ownership of all content generated using the App. We do not store, analyze, or use your generated content for any purpose, including AI training. Content is generated and delivered to you immediately without being saved on our servers.

Our Intellectual Property:

All App technology, including pre-trained AI models, user interface designs, logos, and trademarks, remain the exclusive property of Boom.ink. You may not copy, modify, or create derivative works based on our intellectual property without written permission.

6. Privacy and Data Protection

We take a minimal approach to data collection. We do not collect personal data beyond your email and public X profile information. We do not use any personal data to train AI models. Our AI is pre-trained and does not learn from user inputs. Please review our Privacy Policy for full details.

7. Subscription and Payments

Subscription Plans:

Boom.ink offers various subscription tiers with different features and usage limits. Current pricing and features are displayed in the App.

Billing:

• Payments are processed through Apple App Store or Google Play Store
• Subscriptions automatically renew unless cancelled 24 hours before renewal
• You can manage subscriptions through your device settings
• No refunds for partial subscription periods
• Price changes will be notified 30 days in advance

Free Trial:

New users may be eligible for a free trial period. If you don't cancel before the trial ends, you will be automatically charged for the subscription.

8. Disclaimers and Limitations

Service Disclaimer:

The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee:

• Uninterrupted or error-free service
• Accuracy or reliability of AI-generated content
• Specific engagement or performance results
• Compatibility with all devices or operating systems

Limitation of Liability:

To the maximum extent permitted by law, Boom.ink shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the App. Our total liability shall not exceed the amount you paid for the service in the past 12 months.

User Responsibility:

You are solely responsible for reviewing, editing, and approving all AI-generated content before publication. Boom.ink is not responsible for any consequences resulting from content you publish.

9. Termination

We may terminate or suspend your access to the App at any time for violation of these Terms or for any other reason. You may delete your account at any time through the App settings.

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes through the App or via email. Continued use of the App after changes constitutes acceptance of the new Terms.

11. Indemnification

You agree to indemnify, defend, and hold harmless Boom.ink, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the App, violation of these Terms, or infringement of any third-party rights.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law provisions. Any disputes arising from these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
